关于非法收集的证据能否作为定案的根据,在各国的诉讼法领域中争议颇多.随着法治文明的进步、人权保障意识的增强以及对非法证据危害性的深刻认识,大多数国家都确立了非法证据排除规则.在我国,非法证据能否被采信并且作为定案依据,诉讼法理论界与实务界也是认识不一,争议颇多.我国现行的各诉讼法典尚未对此规则作出明文规定,但随着司法实践的需要,确立非法证据排除规则,势在必行.笔者就此热门问题发表一些粗浅看法,对完善我国的非法证据排除规则进行初步探讨.

On the illegal collection of evidence can be finalized as the basis for national laws in the field of controversial.Along with the rule of law and civilized progress and the protection of human rights and enhance awareness of the dangers of illegal evidence of a profound understanding,most countries have established regulations to exclude illegal evidence.In our country,illegal evidence can be a letter as a final decision and the basis of substantive law theorists and community awareness is one,a lot of controversy.The existing rules of the legal code was not expressly provided for,but with judicial practice needs to establish illegal to exclude evidence rules is imperative.I make some preliminary views on this hot issue,improve our rules to exclude evidence of illegal conduct preliminary exploration.
